In the legal regulation (EC) 2073/2005 published by the European Parliament and the Council, the microbiological criteria for certain microorganisms and the application rules to be followed by the food business operators when applying the general and special hygiene measures in the regulation 852/2004 are explained.

The competent authority shall verify compliance with the rules and criteria set out in this regulation in accordance with regulation (EC) 882/2004, without prejudice to the right to take further samples and analyzes to detect and measure other microorganisms. These studies will be carried out to verify processes for toxins or metabolites for foods that are suspected to be unsafe.

Regulation (EC) 2073/2005, other special rules on the control of microorganisms specified in the European Union legislation, and especially the health standards regarding foodstuffs specified in the legal regulation (EC) of the European Parliament and the Council (EC), the European Parliament's (EC) regulation. It is applied without prejudice to the rules regarding parasites determined within the scope of the legal regulation 853/2004 and the microbiological criteria determined within the scope of the Council's directive 854/2004/EEC.

For the purposes of regulation (EC) 2073/2005,

  • Micro-organisms refer to bacteria, viruses, yeasts, molds, algae, parasitic protozoa, microscopic parasitic helminths and their toxins and metabolites.
  • Microbiological criterion means a criterion that defines the acceptability of a product, a group of foodstuffs or a process based on the absence, presence or number of microorganisms or the amount per unit of their toxin/metabolites.
  • The food safety criterion refers to a criterion that defines the acceptability of a product or a group of foodstuffs applied to products placed on the market.
  • Food for infants means food intended specifically for infants, as defined in Commission directive 91/321/EEC.
  • Food for special medical purposes means dietary food for special medical purposes as defined in Commission directive 1999/21/EC.
  • Sample refers to the part that consists of one or more units or a part of the substance selected in different ways in a significant amount of substance, or that provides information about a particular property of the substance.
