16 CFR 1501 Method of Identifying Toys and Other Articles Intended for Use by Children Under 3 Years of age with Choking, Aspiration, or Swallowing Hazards from Small Parts

The 16 CFR 1501 standard applies to all toys and other items intended for use by children under the age of 3 (36 months). This section 1501 describes the specific clauses that are subject to; lists certain substances that are specifically exempted; and provides a test method for determining whether an object or one of its components is dangerous to children under 3 years of age because it is so small that it may separate or break during normal or reasonably foreseeable use.

Such items include, but are not limited to: squeeze toys; teether; cradle exercises; crib gyms; crib cell phones; other toys or articles intended to be attached to a bassinet, stroller, playpen or stroller; pull and push toys; knocking toys; blocks and stacking sets; bathtub, wading pool and sand toys; rocking, bow and club horses and other figures; bells and musical balls and carousels; jacks in the box; stuffed, plush and herd animals and other figures; Preschool toys, games and puzzles for use by children under 3 years old; riding toys for children under 3 years old; Baby and child furniture such as cradles, playgrounds, baby bouncers and walkers, baby carriages and carriages for use by children under 3 years old; dolls for use by children younger than 3 years, such as dolls, rag dolls and pear dolls; Toy cars, trucks and other vehicles intended for use by children under 3 years old. In addition, such items include other toys or items that are marketed or labeled, intended to be entrusted to or used by children younger than 3 years of age.

For the purposes of this regulation, the following factors are important in determining which toys and other items will be used by children under the age of 3 (36 months): reasonable; advertising, promotion and marketing of the article; and whether the article is generally considered to be intended for children younger than 3 years old.


This regulation does not apply to toys or items intended for use only by children aged 3 years and older. It also does not apply to all items that children under 3 years of age can access simply because they are in a home.
