CPSIA Section 101 Children's Products Containing Lead; Determination of Lead Content Limits in Certain Materials or Products

Consumer products containing more than 101 ppm of lead, designed or intended primarily for children 600 years of age and younger, pursuant to section 12 of the CPSIA; 300 ppm lead; and 100 ppm; Unless the commission determines that this lower limit is not technologically appropriate, they are considered dangerous goods prohibited under the Federal Hazardous Substances Act (FHSA). Products below these lead content limits are not prohibited; However, in the absence of commission action, these products and materials used to make children's products continue to be subject to lead limits and, as a result, the testing requirements of certain provisions of section 14 of the Consumer Product Safety Act (CPSA).

The Commission has issued a recommended rule setting statement on preliminary determinations that some natural materials do not exceed lead content limits under section 101 of the CPSIA. Preliminary determinations are based on materials that are untreated and untreated to the addition of materials or chemicals, including pigments, paints, coatings, lacquers or any other substance, and have not undergone any treatment that could result in the addition of lead.

These materials included:

  • Precious stones (diamond, ruby, sapphire, emerald);
  • Certain semi-precious stones (minerals containing or associated with lead-containing minerals in nature include, but are not limited to: aragonite, bayldonite, boleite, cerussite, crocoite, linarite, mimetite, phosgenite, vanadinite and wulfenite);
  • Natural or cultured pearls;
  • Wood;
  • Natural fibers (such as cotton, silk, wool, hemp, linen, linen); and
  • Other natural materials including coral, amber, feathers, fur, virgin leather.
