EUROLAB laboratory provides testing and compliance services within the scope of 16 CFR 1303 standard. In this standard, paint or dried paint film weight of paint and similar surface coating materials for consumer use containing lead or lead compounds and with a lead content of more than 0,06 percent, hereinafter paint and similar surface coating materials will be referred to as "lead containing paint".
This prohibition is applied to the products included in the categories specified in the clause of this section and produced after 27 February 1978 and which are "consumer products" as defined in the clause. Accordingly, those products described above that are produced or distributed for sale or use, consumption or pleasure to consumers, in or around a household, in schools, recreation or otherwise, are within the scope of the regulation.
Paints and coatings for motor vehicles and boats are not covered by the ban as they are outside the legal definition of "consumer product". In addition to products sold directly to consumers, the ban applies to products used or liked by aftermarket consumers, such as paints used in residences, schools, hospitals, parks, playgrounds and public buildings or other areas where consumers have direct access to the painted surface.
The Commission enacted the ban because it found that there is an unreasonable risk of lead poisoning in children associated with a lead content of more than 0,06 percent in child-accessible paints and coatings, and that there are no applicable consumer product safety standards in this regard. CPSA will adequately protect the public from this risk. 0.06 percent was reduced to 2008 percent effective August 110, 314, as mandated by Congress in section 101(f) of the Consumer Product Safety Improvement Act of 14, Public Act 2009-0,009.
