CPSIA Section 104 Improved Safety Standard for Babies and Infant Products

The Consumer Product Safety Improvement Act strengthened the mandate of the Consumer Product Safety Commission (CSPC), the federal agency that oversees the safety of consumer products. The act also directed the CPSC to issue strong mandatory standards for infant and durable products, requires third-party testing of children's products, requires product registration for infant and durable products, and requires that cribs used in the market comply with the latest robust safety standards.

“Danny Law” created by CPSIA:

Before transitioning to CPSIA, on May 12, 1998, a 16-month-old baby, Danny Keysar, died at a licensed child care facility in the Chicago neighborhood. Danny was killed by a defective children's product, such as the Playskool Travel-Lite - a netted portable crib or playpen - which he took an afternoon nap at the nursery. After Danny's death, his family learned that 1,5 million portable cribs with similar collapsing, top-rail design were sold and subsequently recalled by five manufacturers, but most of them remain undisclosed to this day. As of today, the official death toll from these playgrounds has reached 19 children.

  • Part 104 of the CPSIA, known as the Danny Keysar Child Product Safety Notification Act or “Danny Law,” is named after Danny Keysar.
  • The Danny Act requires the Commission to review and develop safety standards for baby and toddler products.
  • Danny Law applies the scope of the mandatory crib standard to bassinets, portable bassinets and is available for use in hotels, childcare facilities, family day care homes and other places where cribs are offered for use or rental.
  • Danny's Law also requires that many durable baby and infant products, such as cribs, play areas, strollers, and highchairs, include a product registration card that allows consumers to easily register their product with the manufacturer by submitting the card or registering online.
