In 2017, the U.S. Consumer Product Safety Commission (CPSC) issued a final rule banning children's toys and childcare products that contain certain phthalates. This rule limits an effort in almost a decade since Congress passed the Consumer Product Safety Improvement Act (CPSIA) in 2008, which requires regulatory action on certain phthalates. According to the last rule, children's toys and childcare products containing concentrations of diisononyl phthalate (DINP), diisobutyl phthalate (DIBP), di-n-pentyl phthalate (DPENP), di-n-hexyl phthalate (DHEXP) greater than 0,1 percent ) and dicyclohexyl phthalate (DCHP) are prohibited.

CPSIA Section 108 has established permanent and temporary bans on the sale of certain consumer products containing certain phthalates. Banned di(2-ethylhexyl) phthalate (DEHP), dibutyl phthalate (DBP), and butyl benzyl phthalate (BBP) in any amount greater than 0,1 percent.

CPSIA Chapter 108 also directed the CPSC to convene a Chronic Hazard Advisory Panel (CHAP) to examine the child health effects of all phthalates and phthalate alternatives used in children's toys and child care products; and made recommendations to the CPSC on whether any phthalates or phthalate alternatives should be banned, other than those currently permanently banned.


With the last rule, the use of eight phthalates in children's toys and childcare products in concentrations greater than 0,1 percent is now restricted. The final rule includes a paragraph repeating the statutory provision stating that phthalate bans apply to plasticized component parts of children's toys and childcare products, or to other component parts of these products made from materials that may contain phthalates.
