Childcare facilities, family daycares and collective accommodation affecting trade are required to comply with this section, but this provision applies only to childcare facilities, offering or providing family crib use. Childcare homes and public accommodation affect trade and do not affect the sale, resale or other placement of cribs in the trade stream by these organizations.

If a crib has contoured or decorative shafts on one or both sides or ends, the measurement should be determined from the largest diameter of the first pivoted shaft within a range of 10 cm (4 in) above the bearing support spring.

Public accommodation affecting commerce means any inn, hotel or other establishment that provides accommodation to temporary guests; however, the term does not include a facility or a facility located there that is considered an apartment building for purposes of any State or local law or regulation.

This test requirement addresses fatal and non-fatal events involving crib mattresses that tip or fall from their base/stand when they are not properly locked to their base/stand or the latch is not engaged as intended. When the lock or latch is not fully engaged, products that appear to be in a suitable position for their intended use may appear intact, creating a false sense of security. Unsecured or misaligned lock/bolt systems pose a hidden hazard as they are not easily visible to consumers, as they are placed under the bassinet or covered with decorative skirtings.

Additionally, if a bassinet appears stable when placed on a stand/base, consumers will avoid activating lock/latch mechanisms for a variety of reasons. Due to these foreseeable conditions of use, this requirement has been added to ensure that cribs with removable crib mattress feature naturally stay stable or are not properly secured.
